History

The only victory for South Carolina initiative and referendum
advocates in the Progressive era was the enactment of a state law
allowing I&R at the municipal level in 1910.

However, in 1999 there was a major court case that limited the
referendum authority of the state legislature. In Joytime Distributors v.
State of South Carolina, the South Carolina Supreme Court ruled that the
state legislature did not have the authority to place statutes on the ballot
for a general vote of the people.
