Settlement Reached in Big Spring, TX Petition Dispute

Regular readers will recall that Trevor Ford and I traveled to Big Spring, TX back in January to help residents of the city obtain justice, and I am now happy to say that a settlement has been reached between the Concerned Citizens Council of Big Spring and the city of Big Spring, TX. The lawsuit successfully invalidates an emergency meeting that was called in violation of Texas public meeting law to remove a petition relating to the tax rate from the city’s ballot.

As part of the settlement, the city will pay the legal fees incurred by the citizens group. After the announcement of the settlement, the Concerned Citizens Council’s attorney stated,

“The agreement reflects the court’s preliminary ruling that the January 6 was held in violation of the Texas Open Meetings Act. None of this would have happened had it not been for the violation of the Open Meetings Act in connection with the January 6 meeting.”

The so-called “frivolous” petition, which had only one signature, was also found valid! We’d be heading for a tax rollback election if the Texas Statutes were more clearly written with respect to amended appraisals by county tax assessors.
